Judicial Flexibility Act

Purpose: To allow the size of the court to be adjusted to the situation rather than mandating a specific size.
Section 1: Determining the size of the Supreme Court
- When nominating justices to the Supreme Court, the President shall select any number of nominees, not fewer than three (3).
- When confirming justices to the Supreme Court, the number of nominees confirmed by the Senate shall determine the size of the Supreme Court for that term, provided that the size is at least three (3) and not greater than seven (7).
- Once determined, the size of the Supreme Court cannot be changed for that term.
- In the event that fewer than three (3) justices are confirmed by the Senate, then the size of the Supreme Court for that term will be determined to be three (3), and the President and Senate shall continue nominating and voting to confirm additional candidates until a full slate of three (3) justices has been filled.
